Website Terms of Use

These Terms of Use (“Terms”) govern your access to and use of www.WestValleyEventsComplex.com and any related online services provided by West Valley Events Complex, LLC (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Eligibility & Accounts

You must be at least the age of majority in your jurisdiction to use the Site. You are responsible for safeguarding your account credentials and for all activities under your account.

2) Permitted Use; Prohibited Conduct

  • Use the Site only for lawful purposes and in accordance with these Terms and posted policies.
  • Do not attempt to interfere with, damage, or disrupt the Site or its security (e.g., hacking, scraping, reverse engineering).
  • Do not upload unlawful, infringing, defamatory, or harmful content, or violate others’ rights.
  • Do not impersonate any person or entity or misrepresent your affiliation.

The Site and all content, features, and functionality (including text, graphics, logos, images, audio, video, software, and the design/arrangement thereof) are owned by WVEC or its licensors and are protected by intellectual property laws. All trademarks, service marks, and trade names are the property of their respective owners.

4) Ticketing, Purchases, and Refunds

Ticketing and purchases may be processed by third‑party platforms subject to their terms and policies. All orders are subject to availability and confirmation. Event dates, times, and lineups are subject to change. Unless expressly stated otherwise, all sales are final. WVEC reserves the right to refuse or cancel any order and to limit quantities at our discretion.

5) Event Safety; Assumption of Risk

Attendance at live events involves inherent risk. To the fullest extent permitted by law, you voluntarily assume all risks (including personal injury, illness, property loss, or damage) arising from attendance, and you agree to comply with venue rules and lawful instructions of staff and law enforcement.

6) User Content & Feedback

If you submit or post content, you grant WVEC a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, distribute, display, and perform such content for operation and promotion of the Site and events. You represent that you own or have necessary rights to your content. If you provide feedback, you grant WVEC the right to use it without restriction or compensation.

7) Third‑Party Services & Links

Third‑party sites, services, or features accessible via the Site are governed by their own terms and policies. WVEC is not responsible for third‑party content or practices.

8) Mobile Terms (SMS)

By opting in to SMS, you agree to receive recurring text messages as described in the Privacy Policy. Message frequency varies; message & data rates may apply. Text STOP to cancel, HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

9) Disclaimers

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WVEC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WVEC PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR ANY EVENTS OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE WVEC PARTIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID (IF ANY) FOR THE RELEVANT TRANSACTION.

11) Indemnification

You agree to defend, indemnify, and hold harmless the WVEC Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your content, or your violation of these Terms or applicable law.

12) Force Majeure

WVEC will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, weather, fire, flood, epidemic, government action, labor disputes, or network outages.

13) Governing Law; Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.

14) Changes to the Site or Terms

WVEC may modify or discontinue the Site (in whole or part) without notice. We may update these Terms from time to time; the updated Terms will be posted with a new Effective Date. Your continued use constitutes acceptance.
